One of your employees is pregnant and will soon be going on maternity leave. Is she legally entitled to return to exactly the same job once her period of maternity leave ends.
If the employee takes ordinary maternity leave only, she has the right to return to the same job role. Where additional maternity leave is taken, the right is to return to the same job role unless it’s not reasonably practicable. In this case, she must be offered a suitable job on terms that are no less favourable than in her old role.
